Terms of Service

1. Acceptance of the Terms

By accessing and using Talen.to ("the Service"), a service operated by BabyLagoon LLC, a limited liability company organized under the laws of the State of Delaware, United States ("Talen.to", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users and other people who access or use the Service.

2. Description of the Service

Talen.to is a psychometric assessment and culture fit analysis platform designed to support companies in their talent selection processes. The Service includes:

• Psychometric assessments based on the Big Five (OCEAN) model
• Culture fit analysis between candidates and organizations
• Detailed result reports
• Tools to manage selection processes
• Analytics and metrics dashboard

3. Registration and Account

3.1 Eligibility

To use Talen.to, you must be over 18 and have the legal capacity to enter into binding contracts. By registering on behalf of a company, you represent that you have authority to bind your organization to these Terms.

3.2 Account Information

You must provide accurate, complete and up-to-date information when registering. You are responsible for keeping your access credentials confidential and for all activity that occurs under your account.

3.3 Account Security

You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for losses arising from unauthorized use of your account.

4. Acceptable Use

4.1 Permitted Use

You may use Talen.to solely for legitimate hiring and talent assessment purposes.

4.2 Prohibited Conduct

The following is not permitted:

• Using the Service to unlawfully discriminate against candidates
• Sharing assessment results without the candidate’s consent
• Attempting to access other users’ accounts
• Reverse engineering the software
• Using the Service for spam or malware distribution
• Violating data protection or privacy laws
• Reselling or sublicensing the Service without authorization

5. Plans and Payments

5.1 Subscriptions

Talen.to offers different subscription plans. The details of each plan, including features and prices, are available on our pricing page.

5.2 Free Trial

We offer a 14-day free trial that includes 10 assessments. No credit card is required for the trial. At the end of the period, you may choose a paid plan or your account will be deactivated.

5.3 Billing and Renewal

Subscriptions are billed monthly or annually depending on the plan chosen. Your subscription renews automatically at the end of each billing period unless you cancel at least 7 days in advance.

5.4 Refunds

We offer full refunds if you cancel within the first 14 days of your paid subscription. After that period, no refunds are offered for partially used billing periods.

6. Intellectual Property

6.1 Talen.to Content

All content in the Service, including text, graphics, logos, algorithms, software and assessments, is the property of Talen.to and is protected by intellectual property laws.

6.2 Your Content

You retain all rights over the data you enter into the Service. You grant us a limited license to use that data solely to provide and improve the Service.

7. Privacy and Data Protection

The handling of personal information is governed by our Privacy Policy. As a business user, you are responsible for:

• Obtaining appropriate consent from candidates
• Complying with applicable data protection laws
• Using assessment results ethically and lawfully
• Keeping results confidential

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Talen.to will not be liable for:

• Hiring decisions based on assessment results
• Service interruptions or data loss
• Indirect, incidental or consequential damages
• Misuse of the Service by users

Our total liability will not exceed the amount you have paid for the Service in the last 12 months.

9. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if:

• You violate these Terms of Service
• Your use of the Service causes harm to other users or to Talen.to
• You fail to pay the applicable fees

You may cancel your account at any time from your account settings. After cancellation, your data will be deleted in accordance with our Privacy Policy.

10. Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a notice in the Service. Continued use of the Service after the changes constitutes your acceptance of the new Terms.

11. Dispute Resolution

11.1 Mediation

Before starting any legal proceeding, the parties agree to attempt to resolve any dispute through good-faith mediation. If mediation is not successful within 60 days, the parties may proceed with other available legal remedies.

11.2 Jurisdiction

Any legal dispute relating to these Terms will be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States, and both parties consent to their personal jurisdiction, unless otherwise agreed in writing.

12. General Provisions

12.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.2 Waiver

The failure of Talen.to to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

12.3 Assignment

You may not transfer or assign these Terms or your rights under these Terms without our prior written consent. Talen.to may transfer these Terms and its rights without restriction.

12.4 Relationship of the Parties

These Terms do not create a partnership, agency, joint venture or employer-employee relationship between you and Talen.to.

13. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any conflict-of-laws principles. If you are a consumer, you may also have rights under the consumer protection laws of your jurisdiction of residence.
